Welcome to Helep Buy, an eCommerce platform operated by IWOMI TECHNOLOGIES LTD, registered under the laws of the Republic of Cameroon. By accessing or using the HelepBuy platform, you agree to comply with and be bound by the following terms and conditions.
These Terms constitute a legally binding agreement between you and IWOMI. Please read them carefully.
1. Definitions
Platform: The digital service known as "HelepBuy" allowing Users to buy goods from Stores and receive them via Delivery Agents.
User: Any person or legal entity accessing and using the Platform to purchase goods.
Store/Vendor: Businesses offering products for sale through the Platform.
Delivery Agent: Independent contractors responsible for delivering goods purchased via the Platform.
We/Us/Our: Refers to the owners/operators of the HelepBuy Platform.
2. Eligibility
You must be:
At least 18 years old, or legally represented if under 18;
Capable of entering into a legally binding contract under Cameroonian law;
In compliance with applicable laws and regulations.
3. User Responsibilities
Users agree to:
Provide accurate, current, and complete information during registration.
Use the Platform lawfully and only for its intended purpose.
Refrain from tampering with system operations, including fraudulent orders, reviews, or delivery manipulation.
4. Vendor Obligations
Vendors agree to:
Ensure all products listed are legal, genuine, and accurately described.
Set fair pricing and honor listed offers.
Handle complaints and returns in line with Cameroonian consumer protection laws (Law No. 2011/012).
Fulfill orders promptly and update stock availability.
Vendors are responsible for keeping inventory updated in real time.
Product listings must include clear descriptions, images, prices (inclusive of taxes), and delivery expectations.
Vendors shall not upload counterfeit or illegal goods. Such actions will lead to permanent suspension and may be reported to authorities (in accordance with Cameroon’s IP and trade laws).
Vendor performance is monitored via:
Fulfillment rate
Customer rating
Dispute rate
We reserve the right to delist vendors who breach these obligations.
5. Delivery Agent Obligations
Delivery Agents are selected based on identity verification and acceptance of the Delivery Terms Policy.
Delivery Agents must confirm pick-up and drop-off using the HelepBuy app.
Consistent poor ratings or complaints can lead to temporary or permanent deactivation.
Deliver products safely, timely, and respectfully.
Maintain proper records and use platform tools to update delivery status.
Treat Users and Vendors with professionalism.
Comply with road safety regulations and applicable insurance requirements.
Delivery Agents are considered independent contractors, not employees of HelepBuy.
6. Ratings & Reviews
After each transaction, Users can rate Vendors and Delivery Agents.
Ratings influence vendor visibility and delivery agent dispatch priority.
Abuse of rating (e.g., fake reviews or extortion) is prohibited and will result in suspension.
7. Dispute Resolution
Users must raise disputes within 48 hours of delivery via the in-app complaint system.
The platform will:
Investigate the issue
Temporarily hold funds if needed
Recommend resolution based on transaction data and vendor feedback
8. Wallet & Credits (if applicable)
Funds in the in-app wallet remain the property of the User until spent.
The company is not liable for stolen or compromised wallet accounts due to negligence by the User.
9. Promotions & Discounts
Helep Buy may offer discounts or promo codes, which cannot be exchanged for cash.
Any abuse of promotional offers (e.g., fake accounts) will result in account restriction.
10. Platform Availability
While we strive for 24/7 service, we do not guarantee uninterrupted access.
Scheduled maintenance or unexpected outages will be communicated via app notifications.
11. Payments and Fees
All payments are processed through the platform’s secure payment gateway.
The platform may charge a commission on each transaction, which will be disclosed upfront.
Users agree to pay applicable delivery fees, taxes, or service charges.
12. Refunds and Returns
Users are entitled to refunds and returns as per our [Return Policy], in accordance with Cameroonian consumer laws.
Vendors must process accepted returns promptly and cooperate in refund procedures.
Delivery fees may not be refundable unless delivery was not executed.
13. Account Termination
We may suspend or terminate accounts:
For breach of these Terms;
For fraudulent activity;
If required by law or regulatory authority.
Users may terminate their accounts at any time by contacting customer support.
14. Privacy and Data Protection
All data collected is managed in accordance with Law No. 2010/012 on Cybersecurity and Cybercrime in Cameroon. By using the Platform, you consent to our Privacy Policy and use of your personal data for order processing and service improvement.
15. Intellectual Property
All content on the Platform, including logos, software, and product listings, is protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works without permission.
16. Limitation of Liability
We are not liable for:
Vendor errors, out-of-stock issues, or inaccurate listings;
Delivery delays or losses caused by Delivery Agents;
Technical errors beyond our control.
However, we will act in good faith to mediate and resolve disputes.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cameroon. Any disputes arising shall be resolved through amicable settlement or, failing that, by the competent courts of Douala.
18. Amendments
We reserve the right to update these Terms at any time. Changes will be communicated through the Platform or email, and continued use constitutes acceptance.
